Gabriel received his undergraduate degree from the University of Scranton, his Juris Doctorate from Loyola University School of Law, and his Master of Laws in Taxation from Boston University School of Law. He also participated in an international law  program conducted in London, England which was offered jointly by Notre Dame School of Law and the London School of Economics and Political Science.

He and his wife, Kimberly, reside in Tampa with their two children, Nicholas and Alexandra, who are recent college graduates. Gabriel attends daily morning mass at St. Paul’s Catholic Church, is a volunteer in many charitable community endeavors and has a keen interest in European history. The areas of the greatest interest to him are the history of English constitutional law and the era that includes the first half of the twentieth century. Being a cancer survivor, Gabriel is well aware of the need for regular exercise and proper nutrition. Therefore, on most weekday evenings you can find him at one of two local gyms engaging in his usual fitness regime.

He began practicing law in 1982 and began his legal career with a prestigious New York City law firm as an associate assigned to its labor law department. Gabriel established his own firm in 2011 and recently joined Morgan & Akins, PLLC as senior counsel. He is licensed to practice law in the States of Florida, Connecticut and New York and has clients located throughout the eastern and southern United States.

Gabriel is a trusted legal advisor who advises clients on tax, estate and business planning with an emphasis on tax controversy matters. He also provides representation in the full panoply of tax and employee benefit law issues, such as:

• The design, implementation and operation of defined benefit, defined contribution, profit-sharing, 401(k), severance, executive compensation, and many other types of retirement and deferred compensation plans

• All forms of health and welfare plans, including medical, hospitalization, prescription drug, severance and training plans

• Pension plan finding and withdrawal liability issues, including those triggered by business acquisitions, closings and reductions in force

• Audits, investigations and lawsuits involving plan participants, fiduciaries and regulatory agencies (such as the Internal Revenue Service, the Pension Benefit Guaranty Corporation, and the U.S. Departments of Labor and Justice).

Gabriel’s practice extends beyond ERISA and taxation . For example, he has experience  in certain areas of  labor law, including the American Disabilities Act, the Age Discrimination in Employment Act, and the Family and Medical Leave Act. As a result, he applies specific provisions that must be integrated into benefit plans and employee handbooks so as to comply with these rules and satisfy government reporting requirements while fully informing participants. Additionally, he provides

technical support in litigation when fiduciary breaches occur in the administration of an employee benefit plan.

Gabriel is AV rated by Martindale-Hubbell and is a member of the bars of the United States Tax Court, United States Court of Claims and the Supreme Court of the United States. He is a member of the Florida Bar Tax Section and is a frequent lecturer before both professional and community organizations.
